These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Madyra ("we", "us", "our") governing your access to and use of the Madyra mobile application and website (collectively, the "Service"). By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
1. Eligibility
To use the Service you must: • Be at least 18 years of age • Be a resident of, or physically present in, the Kingdom of Saudi Arabia • Have a valid Saudi phone number By using the Service, you represent and warrant that you meet all eligibility requirements. Madyra reserves the right to suspend or terminate accounts that do not meet these requirements.
2. Account Registration and Security
2.1 You must register an account using accurate, current, and complete information. You are responsible for maintaining the accuracy of your account information at all times. 2.2 Your phone number is your sole method of account authentication and recovery. You are responsible for keeping your registered phone number current and accessible. 2.3 You must not share your account or allow any other person to access the Service under your credentials. You are responsible for all activity that occurs under your account. 2.4 You must notify us immediately at support@madyra.com if you suspect any unauthorised use of your account.
3. Restaurant Directory and Coupons Service
3.1 Restaurant Directory. Madyra shows you partner restaurants near your location in Jeddah on an interactive map and in listing screens, so you can discover where to dine. Madyra does not process orders, payments, or bills on your behalf — all dining and payment happens directly between you and the restaurant. 3.2 Listings. Partner restaurant listings (name, brand, cuisine type, location, and contact details) are provided for informational purposes and may change at any time without prior notice as restaurants join or leave the partner network. 3.3 Coupons. Madyra also displays discount codes and offers from partner brands. Each coupon is subject to the terms, validity period, and conditions set by the issuing brand or retailer, not by Madyra. Madyra is not responsible for a brand's failure to honour a coupon. 3.4 No Financial Service. Madyra does not collect bank account details, process cashback, or handle any payment on your behalf.
4. User Obligations and Prohibited Conduct
You agree not to: • Register multiple accounts to abuse coupon offers • Submit false or misleading restaurant suggestions • Attempt to circumvent, reverse-engineer, hack, disrupt, or otherwise interfere with the Service or its security mechanisms • Use the Service in violation of any applicable Saudi Arabian law or regulation • Engage in any conduct that could damage, disable, or impair the Service or servers hosting it • Attempt to gain unauthorised access to any part of the Service or its related systems Violation of any of the above may result in immediate account suspension and, where applicable, referral to the relevant legal authorities.
5. Intellectual Property
The Service, including its content, features, design, trademarks, and technology, is owned by Madyra and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely for its intended purpose. You may not copy, modify, distribute, reverse-engineer, or create derivative works from any part of the Service without our express written consent.
6. Privacy and Data
Your use of the Service is also governed by our Privacy Policy, incorporated herein by reference. By using the Service you acknowledge and consent to the collection and use of your data as described in the Privacy Policy, including: • Approximate or precise location, used to show restaurants near you • Phone number stored only as an irreversible cryptographic hash • App usage data, used to improve the Service and detect abuse
7. Disclaimers
7.1 The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. 7.2 Madyra does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. 7.3 Restaurant listings and coupon offers are subject to partner availability and may be modified, suspended, or discontinued at any time.
8. Limitation of Liability
To the maximum extent permitted by applicable Saudi law, Madyra and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the Service, including any dispute with a partner restaurant or brand regarding a coupon.
9. Account Suspension and Termination
9.1 By You. You may close your account at any time by contacting support@madyra.com. 9.2 By Madyra. We reserve the right to suspend or permanently terminate your account, with or without notice, if: • You breach any provision of these Terms • We detect fraudulent, abusive, or illegal activity on your account • You fail to meet eligibility requirements • We are required to do so by applicable law or regulation 9.3 Effect of Termination. Upon termination, your right to access the Service ceases immediately. Madyra's obligations under mandatory data retention periods survive termination.
10. Changes to These Terms
We may update these Terms from time to time. We will provide at least 14 days' notice of material changes via in-app notification or email. The current version of these Terms will always be available at madyra.com/terms. Your continued use of the Service after the effective date of any update constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service and close your account.
11. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the competent courts of the Kingdom of Saudi Arabia.
